When Must a Landlord Return a Security Deposit in Florida?
After moving out, a tenant should receive their security deposit within 15 days of having left the property. However, if your landlord intends to keep your deposit because of property damage or violations, they have 30 days to send you a written explanation for why they are keeping the deposit. The letter should include a detailed outline of the damage they believe you have done to the property and a description of how much money they are keeping to cover those specific damages.
Failure to send this letter can negate the landlord’s right to keep a security deposit. Tenants can go to small claims court to seek the court’s help in getting their security deposit back in cases where landlords fail to return their deposits and fail to send a written explanation within a month.
Handling Security Deposit Deductions for Pre-Existing Damage
If your Florida landlord withholds part of your security deposit for repairs, but you believe the damage already existed when you moved in, you can fight the deductions. While the burden of proof falls on the landlord to demonstrate the damage was your fault and not pre-existing, you will need to submit a written objection to your landlord.
If you plan to object to the withholding of your deposit, you will need to have your move-in inspection report (if one was completed) and any photos you took documenting the pre-existing damage. Then, contact your landlord and explain your disagreement with the deductions.
Be sure to send the letter through a certified or verifiable method so you can have proof of delivery. If you can't reach an agreement, involving a real estate attorney can be a strong next step, as they can help navigate the dispute resolution process or even file a lawsuit in small claims court to recover your withheld funds.
